Under the federal Identity Theft Act, a criminal offense is committed if a
person knowingly transfers or uses, without lawful authority, a means of
identification of another person with the intent to commit, or to aid or
abet, any unlawful activity that constitutes a violation of Federal law, or
that constitutes a felony under any applicable State or local law The
relevant section of this legislation is codified at 18 U.S.C. §
1028(a)(7)(fraud and related activity in connection with identification
documents and information). According to an analysis of the new law by
the United States Sentencing Commission:3
• Before passage of the 1998 act, the unauthorized use or transfer of identity
documents was illegal under title 18 of the U.S. Code, section 1028—which
included subsections (a)(1) through (a)(6). The unauthorized use of credit
cards, personal identification numbers, automated teller machine codes,
and other electronic access devices was illegal under another section of
the U.S. Code—that is, 18 U.S.C. § 1029 (fraud and related activity in
connection with access devices).
• The addition of subsection (a)(7) to section 1028 expanded the definition
of means of identification to include such information as SSN and other
government identification numbers, dates of birth, and unique biometric
data (e.g., fingerprints), as well as electronic access devices and routing
codes used in the financial and telecommunications sectors.
• Under the Identity Theft Act, the new definition of means of identification
includes prior statutory definitions of identification documents.
According to the United States Sentencing Commission, a key impact is to
make the proscriptions of the new identity theft law applicable to a wide
range of offense conduct, which can be independently prosecuted under
numerous existing statutes. That is, any unauthorized use of means of
identification can now be charged either as a violation of the new law or in
conjunction with other federal statutes.

I have been thinking about this a lot and was wondering why if someone commits fraud against an organisation(in the context of banking or credit card companies) is it seen as identity theft. The inmplication is, I assume, that it is the individuals responsibility and not the organisations.

Identity theft means that someone has stolen someone other’s identity to pretend to be someone else. It can include stealing social security numbers to obtain credit or stealing the whole identity(identity cloning) to commit a crime.
Banking card companies have a set of information they can use to verify that the person they are currently serving is the one he claims to be. This information can be obtained illegally and this is why this is called identity theft.

A relative may of committed credit card fraud and I was wondering if the bank would ask that the debt be paid, or drop the issue at a certain dollar amount, or have law enforcement intervene. If law enforcement was to get involved, what would they typically do?

If the "mistake" is paid in full promptly, the bank will probably let it go. Not paying promptly is generally considered confirmation of fraud. Banks are becoming far more aggressive in collecting these days — they have to.

Each bank determines their own criteria for pursuing fraud charges. And they are disinclined to discuss or publicize those criteria for obvious reasons. But banks (and other lenders) are definitely pursuing criminal charges on much smaller amounts than they did a year or two ago. And they are pushing prosecutors/district attorneys much harder to go after these.

Maybe the most significant PC security query you need to be involved with is the protection both your checking account and your identity info related to your bank.

We are not speaking here of the steps a PC user needs to take to protect bank and identity info on their hard disk, but the I. D. theft protection your bank is taking to protect information on you. It’s been known since 2006 that many banks have proved exposed to ID theft. In that year, Wachovia Bank had 441 reported cases of I. D. theft, HSBC, 571, Discover, 667, Well Fargo, 786, Washington Mutual / Providian 885, Citibank, 1249, Capital One, 1328, JP Morgan / Chase / Bank One, 1839 and Bank of American / MBNA, 3351, according to a statement covering an insignificant a quarter ( figures taken from Hoofnagle’s report made public in Personal computer Mag ). Since that point, the numbers have improved, but reported cases have not vanished. There are 2 types of ID theft found in banks. One, the one you are most worried about, is account takeovers. The banks have to be worried about the other kind ; it is known as man-made I. D. theft. In this situation, a hacker creates a new account, a fake account with a fake identity. It’s an identity theft protection issue to the limit that if a hacker can make a new account in the bank’s production systems, the same hacker could also use the same methodologies to view and maybe manipulate other accounts, including yours. Then, the hacker can take over your account, and your identity. Whether your identity is exposed or the bank is exposed, ID theft protection or ID theft prevention is the issue ; more basically, the entire security policies of the bank is the issue. What’s been done since 2006? For one thing, ID theft protection has come to the front line of system designers, engineers, chiefs and so on, as a basic design requirement for any bank info system.

This isn’t to assert that security hasn’t always been a basic consideration ; it has become a problem that will establish the feasibility of the bank and of its standing in the business.

Many banks that were an element of the I. D. theft problem in 2006 are gone now or have suffered superb downsizing.

This in itself is wearisome : less cash for info security, for information security consultants, means more exposure for you. We can’t say with certainty the contemporary bank issues are are all conscious of has, with no question, made banks and their ID theft protection policies, procedures, strategies, and controls more exposed. It may not have an appreciable impact .

But one thing is sure : when money is scant, protection and the engineering wanted to implement it simply can’t be afforded. What does the downfall and chaos in the banking industry signal to you about the safety of your identity? Specifically this, that you’d be sensible to test out your banks security performance now. It’s only reasonable : the less guards you have at the gates, the less protection you have. Ask your bank now how their security has performed and check out net sites that are following this difficulty now.
